This is the privacy policy (“Privacy Policy”) that governs how we, EOS S.r.l. and/or our subsidiaries and/ or affiliates, (individually and collectively “EOS S.r.l.”, “EOS”, “EOS Instruments”, ”we”, “our” or “us”), use Personal Information (defined below) that we collect, receive and store about individuals who use and visit the website www.eosinstruments.com (together with its subdomains, content and services, the “Site”).

  1. Introduction. We have implemented this Privacy Policy because your privacy, and the privacy of other Site’s users, is important to us. We provide this Privacy Policy explaining our online information practices and the choices you can make about the way your Personal Information is collected and used in connection with the Site. “Personal Information” means any information that may be used, either alone or in combination with other information, to personally identify, locate, or contact an individual, including, but not limited to, a first and last name, an email address, a home or other physical address, or other contact information.
  2. Consent and Modification. This Privacy Policy forms part of the EOS website terms of use, available at Terms & Conditions. Capitalized terms not defined herein shall have the meaning ascribed to them in the Terms. By using the Site, you consent to the terms of this Privacy Policy and to EOS processing of Personal Information for the purposes set forth herein. If you do not agree to this Privacy Policy, please do not use the Site. We reserve the right, at our discretion, to change this Privacy Policy at any time. Such change will be effective ten (10) days following posting of the revised Privacy Policy on the Site, and your continued use of the Site thereafter means that you accept all those changes.
  3. Receipt and Collection of Information. We receive and/or collect Personal Information from you in the following ways:
    1. Account. In order to use the Site and/or some of its services, you may have to create and register an account (an “Account“). You can complete and submit an online registration form which we make available on the Site. You will be asked to provide us certain contact and personal details. We will explicitly indicate the fields that are mandatory to complete. If you create your Account, you must provide accurate and complete information for yourself. You are solely responsible for the activity that occurs in your Account, and you must keep your Account password secure. You must notify us immediately of any unauthorized use of your Account. You may deactivate your Account at any time by following the options within the Site.
    2. Contact Us’ Information. If you choose to send us a “Contact Us” request by sending an email to an email address that we display on the Site, you may be required to provide us with certain Personal Information such as your name and email address. You may also choose to provide us with additional Personal Information.
    3. Site Cookies, Log-Files and Tracking Technologies. The Site may utilize “cookies”, log-files and other tracking technologies. A “cookie” is a small text file that may be used, for example, to collect information about Site activity. Some cookies and other technologies may serve to recall Personal Information previously indicated by a Site user. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser.
  4. How do we treat messages you send us? The Way We Use Personal Information. If you submit to us or we collect Personal Information through the Site, then such Personal Information may be used in the following ways:
    1. When you send us a message by e-mail or through this contact form, your personal data is collected only to the extent necessary to reply. In the case of an e-mail, if the management team of the mailbox is unable to answer your question, it will forward your e-mail to another service. You will be informed, via e-mail, about which service your question has been forwarded to. In the case of a message sent via the above contact form, your data can be accessed by the team managing the contact form database, and by the service to which the query is directed. It will not be disseminated outside the boundaries of these services. Upon submission of your message, the system automatically stores it and sends a copy of your request by e-mail to the relevant EOS internal mailbox, depending on the topic and content of your message. The stored message will be erased within 90 working days, and its e-mail copy will be kept in the relevant service e-mail archives only as a reference for further correspondence / audit. It will be deleted after termination of the legal period for conservation of electronic documents. The reasons for using a contact form instead of providing you with an e-mail address are: 1) to avoid as much as possible robot-generated spam, 2) to better process your request by sending it to the proper EOS service and 3) to allow you to send us a message without having to use an e-mail client. If you have any questions about the processing of your e-mail or contact form request and related personal data, do not hesitate to include them in your message;
    2. If authorized, we will use your Personal Information to identify and authenticate your access to the parts of the Site and services that you are authorized to access.
    3. We may disclose your Personal Information or any information you submitted to us via the Site if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our Terms including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of EOS, its users, yourself or the public;
    4. Responsabile della protezione dei dati (RPD) – Data Protection Officer (DPO) contact: Tiziano Sanvito (PhD), EOS Sole Administrator, MAIL: tiziano.sanvito@eosinstruments.com, PEC: eos-srl@pec.eosinstruments.com  .

  6. Opting-Out. You explicitly agree that we may send you notifications regarding the Site, our services and third party’s notifications and/or advertisements. You may choose not to receive future promotional, advertising, or activity related emails from us by selecting an unsubscribe link at the bottom of emails/notification that you receive from us. Please note that even if you opt out of receiving the foregoing emails/notifications, we may still send you a response to any “Contact Us” request as well as administrative emails that are necessary to facilitate your use of the Site.
  7. Choice. At all times, you may choose whether or not to provide or disclose Personal Information to us. The notices that we provide on the Site in circumstances where we collect Personal Information should help you to make this choice. If you choose not to provide the Personal Information we request, you may still visit parts of the Site, but you may be unable to access certain options, programs, offers, and services that involve our interaction with you.
  8. Access/Accuracy. To the extent that you do provide us with Personal Information, we wish to maintain accurate Personal Information. If you would like to correct a material inaccuracy in your Personal Information that we may be storing, you may submit an access request by sending an email to info@eosinstruments.com. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security. If you have any comments or questions regarding our privacy policy, please contact us at info@eosinstruments.com
  13. Social Media Widgets. Our Site can include Social Media Features, such as the Facebook Like button, Twitter, Linkedin, Widgets and/or others. These Features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the Feature to function properly. Your interactions with these Features are governed by the privacy policy of the company providing it.
  14. In the Event of Merger, Sale, or Bankruptcy. In the event that EOS is acquired by or merged with or into a third party entity, we reserve the right to transfer or assign Personal Information that we have collected as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how Personal Information is treated, transferred, or used. In any of the circumstances described in this paragraph, the information will be subject to the privacy policy of the purchaser or assignee.
  15. Commitment. We are committed to protecting your privacy. Protecting your privacy online is an evolving area, and we are constantly evolving our Site to meet these demands. If you have any comments or questions regarding our Privacy Policy, please contact us at info@eosinstruments.com
